[ARCHIVED] PUBLIC NOTICE OFFER FOR SALE

Notice is hereby given, as provided in K.S.A. 19-211, et. seq. that the Franklin County, Kansas, Board of County Commissioners is offering for sale, in its present (AS IS) condition the following parcel of real property owned by Franklin County, Kansas:

 Commencing at a point thirty (30) feet south of the southwest corner of Lot 23, Block 1, Tyman’s Subdivision, an addition to the City of Ottawa, Kansas, thence West 340 feet; Thence South 30 feet; Thence East 340 feet; Thence North 30 feet to the place of beginning. 

This property is commonly known as 1124 W. 7th Street Terrace, Ottawa, Kansas.  This property is subject to the City of Ottawa’s building and zoning regulations and is currently zoned R-1.

The sale will be conducted via public auction on February 11, 2025, at 11 a.m. at 1124 W. 7th Street Terrace, Ottawa, Kansas.  Franklin County reserves the right to reject any or all bids and to waive any irregularities or informalities in bidding.

 The property is being sold AS IS.  Franklin County makes no representations regarding the condition of the property or its suitability for any particular purpose.  The successful bidder will be purchasing the property in its then present condition with all faults and defects, whether visible or not.  No warranties or guarantees are, or will be, given by Franklin County.

The sale of this property is contingent upon the successful bidder agreeing to lease the accessory building located on the property (directly south of the main structure) to the Franklin County Historical Society for a period of two years from the closing date of the sale.  The amount of said lease shall not exceed one hundred and twenty dollars ($120) annually.

 The sale of the property will be subject to any and all matters of record affecting the property as recorded with the Franklin County Register of Deeds Office.  The successful bidder will be responsible for any survey, title insurance and closing costs.

By submitting a bid, the bidder is agreeing to close on the purchase of the property within thirty (30) days of acceptance of the bid by the Franklin County Board of County Commissioners.  The successful bidder agrees to pay a fifteen thousand-dollar ($15,000) escrow payment, made via cashier’s check, by 4:00 p.m. on the day of the sale.
